Relationship

You agree that no joint venture, partnership, employment or agency relationship exists between you and ICHIBA USA, INC as a result of this agreement or your use of this Site. 

All engine modification and suspension components except those that are exempt, have been designed and are intended for off-highway application. These components are legal in California for racing vehicles only, which may never be used on public roads and highways. Federal and many state laws prohibit the removal, modification, or rendering inoperable of any device or element of design affecting vehicle emission or safety in a vehicle used on public highways. Violation of such laws may subject the owner or user to a fine or penalty. Installation of this part may void the vehicle's manufacturer warranty coverage, if any, on your vehicle. Vehicles modified by the use of performance parts may no longer be lawfully used on public highways. 

WARRANTY: No warranty whatsoever will be given if the defect was caused by customers' abuse, negligence, mishandling, or improper installation. All merchandise sold by ICHIBA USA, INC for warranty are subject for inspection and approval for repair or replacement of merchandise. Customer, however, will be responsible for all shipping and handling fees. No labor or inconvenience may be included in any warranty claims. Check your state and local laws regarding the use on any parts. 

PRODUCT INFORMATION AND DESCRIPTIONS

ICHIBA USA, INC  attempts to be as accurate as possible. However, ICHIBAUSA.COM does not warrant that product descriptions, color (actual colors you see will depend on your monitor, we cannot guarantee that your monitor’s display of any color will be accurate) or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by ICHIBAUSA.COM  itself is not as described, your sole remedy is to return it in unused and unopened condition.

GOVERNING LAWS

By visiting ICHIBAUSA.COM, you agree that all legal issues arising from or related to the use of the ICHIBAUSA.COM web site and its services shall be construed in accordance with, and all questions with respect thereto shall be determined by, the laws of the state of California applicable to contracts entered into and wholly to be performed within said state, unless expressly stated to the contrary elsewhere within these Conditions of Use.

DISPUTES

Any dispute relating in any way to your visit to ICHIBAUSA.COM or to products you purchase through ICHIBAUSA.COM shall be submitted to confidential arbitration in Los Angeles, California, except that, to the extent you have in any manner violated or threatened to violate ICHIBAUSA.COM's intellectual property rights, ICHIBAUSA.COM may seek injunctive or other appropriate relief in any state or federal court in the state of California, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under these Conditions of Use shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under these Conditions of Use shall be joined to an arbitration involving any other party subject to these Conditions of Use, whether through class arbitration proceedings or otherwise.

Return Policy:

ICHIBA USA INC. Can be process returns and refunds only for items purchased from www.ichibausa.com

·         Return for exchange or refund will be allowed only within 14 calendar days from the date of receipt of merchandise with no exception.

·         All Authorized return merchandise must be unused and in its original saleable package.

·         No return or exchange on merchandise that shows signs of having been installed, mounted, scratched or defaced will be allowed.

·         Returns must be sent freight prepaid and insured by you; original shipping and handling charges are not refundable.

·         25% restocking fee will be assessed on all authorized returns.

·         No cancellations, refunds, or exchanges on special order items or custom order items will be allowed.

·         Defective or Damaged items can be exchange; make sure check the box conidtion with the driver before signing the package.

Returning items purchased from Authorized ICHIBA USA Dealers: www.ichibausa.com can not accept returns of items purchased from Authorized ICHIBA dealers. Instead, customer must contact the Authorized ICHIBA Dealer from which you purchased the item to determine the Dealer's return policy (which might be different than www.ichibausa.com)

Pricing Policy:

ICHIBA USA INC. offer certain Consumer Products for on-line sales. These items are identified with the “BUY” icon to the right of the Product description and Price. Products identified with “Dealer” are only available through Authorized ICHIBA Dealers. Simply click on the “Dealers” Link to see our Dealer Directory. All prices are listed in U.S. dollars. We do not offer a currency converter, however there are several Web sites that provide this service. We do not offer additional discounts on large orders of a single Product or on large orders of many individual Products.
